The essay analyzes not only the fascist legislation (adopted in the years 1938 and 1939) concerning the denial of access to work for the Jewish and the system of remedies set up in the following years, but also the reactions by scholars and judicial bodies to such legal acts. The analysis is carried out with particular attention to the implications arising from the language used by the fascist Regime. In the final part, the essay deals with the influence of racial persecutions in the drafting of the constitutional provisions dedicated to work.
