The work focuses on the voice “good governance”, the concept and fundamental principle of authority´s legitimacy and therefore in its exer- cise according to the legal and political vision of the 16th century´s Spaniard Empire/Monarchy. The theoretical framework will be drawn starting from Solon, Lycurgus and Plato to the Christian philosophers, going through jurists such as Bartolo da Sassoferrato. The latter considers the “civil wisdom” to be the basis of the art of “good governance”, whose fundamental requirement is respect for the law and the norm, confirming the importance of the studies and active enrollment of lawyers in the government of the city (VIROLI: 1994). Finally, the ruling principle of the monarchy, the “good governance” that meant pro- viding to each individual his due, and to protect and defend the weak against the strong (LIRA: 2004), keeping the ruling order. The viceroy as institutional figure is part of the “good governance” and stands as the guardianship and pro- tects the inhabitants of the New Spain

Abstract

El trabajo se centra en la voz “buen gobierno”, concepto y principio fundamental de legitimación de la autoridad y, de consecuencia, su ejercicio según la visión jurídico-política del siglo XVI del imperio/monarquía española. El marco teórico mostrado con pinceladas que van desde Solón, Licurgo y Platón, hasta los filósofos cristianos, pasando por juristas como Bartolo da Sassoferrato. El jurista considera la “sabiduría civil” como base del arte del “buen gobierno”, cuyo requisito fundamental es el respeto de las leyes y del derecho, confirmando la importancia del estudio y participación de los juristas en el gobierno de la ciudad (VIROLI: 1994). Finalmente, el principio regente de la monarquía, el “buen gobierno”, significó dar a cada quien lo suyo y proteger y amparar al débil contra el fuerte (LIRA: 2004), manteniendo el orden dado. El virrey, en tanto figura institucional, se enmarca en el “buen gobierno” y representa quien tutela y ampara a los habitantes de la Nueva España.
