The overall message of this chapter is that human rights law is a viable and unavoidable framework for addressing the contemporary challenges arising from climate change. The paper proceeds by considering and refuting the various objections advanced against a human rights approach to climate change, such as the difficulty of attributing the diffuse harm stemming from climate change to specific States, the fundamentally extraterritorial nature of climate change-related human rights breaches, the uncertainty in identifying precise victims of such violations, and the purported inadequacy of human rights regimes to provide redress for potential violations and potential victims.
