When discussing European and international principles related to tax trial, we are in fact talking about art. 6 of the ECHR, art. 47 of the EU Charter of Fundamental Rights and art. 111 of our Constitution. Some of the national regulatory gaps may be bridged only through the legislative action, through a wrecking or additive intervention of our Constitutional Court, or a ruling by the ECHR, or by the EU Court of Justice. Other gaps might be bridged adopting the constitutionally oriented interpretationmethod, focusing on art. 111 of the Constitution, considering the fullness of proof related to the ne bis in idem principle, and on art. 50 of the EU Charter of Fundamental Rights.
Parlare di princìpi europei ed internazionali in ambito processuale tributario significa riferirsi all’art. 6 della CEDU, all’art. 47 della Carta dei diritti fondamentali dell’UE e al nostro art. 111 Cost. Alcune lacune della normazione nazionale possono essere colmate solo con interventi del legislatore oppure con intervento demolitore o additivo della Corte costituzionale, con sentenza dalla Corte Edu o pronuncia della Corte di Giustizia UE. Altre lacune possono essere colmate assumendo a modello di scrutinio il metodo dell’interpretazione costituzionalmente orientata, privilegiando l’art. 111, comma 1, Cost., anche per garantire il diritto alla pienezza delle prove avuto riguardo al divieto del bis in idem e all’art. 50 della Carta europea dei diritti fondamentali dell’UE.
